1. Overview

Welcome to Emmamorton. The terms “we,” “us,” and “our” refer to Emmamorton.

We operate emmamorton.com, including the related information, content, features, tools, products, and services (collectively, the “Services”). Our store is powered by Shopify, which provides the technology that enables us to offer the Services.

These Terms of Service, together with the policies referenced below, describe your rights and responsibilities when accessing the Services or purchasing from our store.

By accessing or using the Services, you agree to these Terms of Service. If you do not agree, please do not use the Services.

Our Privacy Policy explains how we handle personal information. Your use of the Services does not replace any separate consent required by applicable privacy law.

Nothing in these Terms limits rights or remedies that cannot be excluded under applicable consumer protection laws.

2. Eligibility and Account Information

Colors and appearance may vary depending on your device and display settings. Please review the product description, materials, measurements, and available sizing information before ordering.

Display differences do not remove your rights if an item is defective, incorrect, or materially different from its description.

We may update product listings, discontinue products, or limit quantities for legitimate reasons, including stock availability, suspected fraud, or legal restrictions. Changes to a listing do not automatically change the terms of an order we have already accepted.

4. Orders and Acceptance

Placing an order constitutes an offer to purchase the selected products under these Terms. You authorize payment of the total amount displayed at checkout using your selected payment method, subject to any payment plan you separately accept with a payment provider.

An automated acknowledgment confirms that we have received your order. Acceptance occurs when we confirm that we have accepted or shipped it.

We may decline or cancel an order for legitimate reasons, such as product unavailability, an unresolved pricing error, payment failure, suspected fraud, or a legal restriction.

If we decline or cancel an order after collecting payment, we will notify you and promptly refund the amount paid for the canceled items, including applicable taxes and shipping charges.

We will not substitute products or increase the agreed order total without your consent.

Purchases are intended for personal or household use. We may limit orders reasonably identified as purchases for unauthorized commercial resale.

5. Prices, Payments, and Promotions

The applicable price and currency are displayed at checkout. Please review your order total before submitting payment.

Applicable taxes and any charges will be disclosed before you complete your order. We offer free standard shipping on United States orders as described in our Shipping Policy.

Payment methods available for your order are displayed at checkout. Availability may depend on your location, device, and payment-provider eligibility.

You represent that you are authorized to use the payment method provided. Payments are subject to authorization by your card issuer or payment provider.

If you select an installment payment option, eligibility, repayment schedules, interest, and other applicable conditions are governed by the terms presented by the payment provider.

Promotions may have additional conditions, such as eligibility requirements or expiration dates. These will apply to the relevant promotion and do not override mandatory consumer rights.

Price changes made after an order is accepted do not change the agreed price of that order.

6. Order Changes and Cancellations

If you need to change or cancel an order, contact info@emmamorton.com as soon as possible.

We will check whether the request can be accommodated. Changes or cancellations may not be possible once an order has been prepared or shipped.

If an order cannot be canceled, eligible products may still be returned under our Return and Refund Policy.

This section does not restrict any cancellation or refund rights provided by applicable law.

7. Shipping and Delivery

Shipping destinations, costs, order cutoff times, processing times, and delivery estimates are explained in our Shipping Policy.

For United States orders, our estimated processing time is 1–3 business days, followed by an estimated transit time of 6–9 business days. The combined estimate is 7–12 business days, subject to the cutoff time, weekends, and public holidays described in that policy.

Delivery dates are estimates rather than guaranteed arrival dates. However, this does not remove our obligations to fulfill orders or provide remedies required by law.

If we cannot ship within the stated timeframe, we will provide notice and, where required by law, offer you the choice of agreeing to a revised shipping date or canceling the unshipped order for a prompt refund.

Please contact us if your shipment is delayed, missing, damaged, or marked delivered but cannot be located. We will review the issue and work with the carrier where appropriate. Handover to a carrier does not eliminate your applicable consumer rights.

8. Returns, Exchanges, and Refunds

Our Return and Refund Policy explains eligibility, return conditions, mailing instructions, return shipping costs, exchanges, and refund processing.

For eligible United States orders, we accept returns of defective and non-defective products within the stated 30-day return window. We also accept exchanges and do not charge a restocking fee.

Please review the full policy before mailing a return. Our business address should not be used as a return address unless confirmed in our return instructions.

These Terms do not reduce any rights available under that policy or applicable law.

9. Intellectual Property

The Services contain material owned by Emmamorton or used under permission or license, including text, images, graphics, logos, designs, video, and other content.

These materials are protected by applicable intellectual property laws. Purchasing a product does not transfer intellectual property rights in the product, its design, or related content.

You may use the Services for personal shopping and other lawful purposes. Except where permitted by law or authorized by the rights holder, you may not reproduce, distribute, modify, or commercially exploit protected content.

Emmamorton, Shopify, and third-party names and trademarks remain the property of their respective owners. Nothing in these Terms implies ownership of third-party trademarks or an endorsement by their owners.

10. Third-Party Tools and Links

The Services may include optional tools, integrations, or links provided by third parties.

Your use of these services may be subject to separate terms and privacy policies. Please review them before using the relevant service or providing information.

We do not control independent third-party websites or their content. To the extent permitted by law, we are not responsible for their independent acts or omissions.

This section does not remove our responsibilities for orders placed with Emmamorton or for service providers acting on our behalf where applicable law makes us responsible.

11. Relationship with Shopify

Emmamorton is powered by Shopify, which enables us to provide the Services to you. When you use the Services, your device communicates with Shopify’s systems to deliver the Services.

Sales and purchases made through our store are directly between you and Emmamorton. Shopify is not the seller of the products offered by Emmamorton and is not responsible for fulfilling our orders or handling our customer service obligations.

To the fullest extent permitted by applicable law, you release Shopify and its affiliates from claims arising from purchases and transactions between you and Emmamorton. This does not exclude obligations or liability that cannot lawfully be excluded, or rights you may have under a separate agreement with Shopify.

Our collection, use, and disclosure of personal information are described in our Privacy Policy.

Shopify also processes information about your interactions with the Services, including for hosting, payment processing, security, fraud prevention, and other purposes described in its policies.

If these Terms conflict with our Privacy Policy regarding the processing of personal information, the Privacy Policy controls.

13. Reviews and Feedback

If you submit a review, suggestion, or other content for publication, you represent that you have the necessary rights to submit it and that it reflects your honest experience or opinion.

You retain ownership of your content. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and reasonably format that content to operate, improve, and promote the Services, subject to applicable law and our Privacy Policy.

This permission does not authorize us to misrepresent your opinion or publish private customer service correspondence as a testimonial without permission.

Please disclose any compensation or incentive associated with a review.

Submitted content must not infringe another person’s rights, contain unlawful threats or harassment, impersonate another person, or introduce malicious software.

We may remove content that violates these requirements. We do not prohibit or remove reviews solely because they express a negative opinion.

14. Errors and Corrections

If a material error affects your order, we will contact you to explain the issue and the available options. We will not charge an increased price without your agreement.

If we cannot fulfill an order on the agreed terms and the order is canceled, we will promptly refund the amount paid for the canceled portion.

We may restrict or block automated activity that violates these requirements. Automated access expressly authorized by us or supported through an approved integration remains subject to the relevant permissions and terms.

Termination does not eliminate obligations relating to existing orders, valid refunds, or rights that accrued before termination. Provisions that are intended to continue, including intellectual property protections and applicable liability provisions, will survive termination.

18. Warranties

We aim to keep the Services accurate and operational but do not guarantee that website access will always be uninterrupted or error-free.

To the extent permitted by applicable law, the website and optional online tools are provided on an “as available” basis.

Nothing in these Terms excludes an express product promise, our obligations under the published return policy, or any warranty or consumer guarantee that cannot lawfully be excluded.

19. Limitation of Liability

To the fullest extent permitted by applicable law, Emmamorton and its service providers will not be liable for indirect, incidental, special, or consequential losses arising from use of the Services, such as loss of business profits or business opportunities.

These limitations do not exclude liability for fraud, willful misconduct, or any other liability that cannot be limited by law.

They also do not remove your rights to receive purchased products, obtain an applicable refund, or seek remedies for defective or misdescribed goods.

20. Indemnification

To the extent permitted by law, you agree to indemnify Emmamorton and its relevant service providers against reasonable third-party claims and costs resulting from your unlawful use of the Services, infringement of another person’s rights, or material breach of these Terms.

This obligation does not apply to losses caused by the party seeking indemnification’s own negligence, misconduct, or breach of law.

We will notify you of any claim for which indemnification is sought and provide a reasonable opportunity to participate in its defense. No settlement imposing obligations on you will be agreed without your consent.

21. Events Outside Our Reasonable Control

Events such as severe weather, natural disasters, carrier disruptions, or interruptions to essential infrastructure may affect our ability to provide the Services.

Where an event materially affects an order, we will communicate available information and take reasonable steps to resolve the issue.

Such events do not remove notification, cancellation, refund, or other obligations imposed by applicable law.

Nothing in these Terms prevents you from relying on protections available in your place of residence or bringing a claim before a court that has jurisdiction under applicable law.

A failure to enforce a provision on one occasion does not waive the right to enforce it later.

You may not transfer your contractual rights or obligations without our consent, except where permitted by law. We may transfer these Terms as part of a legitimate business transfer, provided this does not reduce your rights or protections and any legally required notice is given.

24. Entire Agreement and Policy Priority

These Terms and the policies referenced in them form the agreement governing your use of the Services and purchases from Emmamorton.

The Shipping Policy governs specific shipping arrangements. The Return and Refund Policy governs specific return, exchange, and refund arrangements. The Privacy Policy governs personal information processing.

Nothing in these Terms overrides mandatory legal rights or specific commitments we made when accepting your order.

Section headings are provided for convenience and do not change the meaning of the Terms.

We may send order confirmations, shipping updates, customer service replies, and other transaction-related communications electronically using the contact details you provide.
